How Tennessee Law Defines & Punishes Manufacturing

Tennessee Code § 39-17-417, part of the Tennessee Drug Control Act of 1989, broadly defines manufacturing to include production, preparation, processing, extraction from natural substances, and independent chemical synthesis. That reach means the statute covers everything from a methamphetamine lab to a cannabis grow operation to psilocybin cultivation. Penalties follow the controlled substance schedule and quantity involved.

The felony classifications break down this way:

• Class B felony: Manufacturing a Schedule I substance carries 8 to 30 years and a fine up to $100,000
• Class A felony: Manufacturing 300 grams or more of cocaine or methamphetamine, or 150 grams or more of fentanyl, elevates the charge to 15 to 60 years and a fine up to $500,000
• Class D felony: Manufacturing a Schedule III substance carries a fine up to $50,000
• Class E felony: Marijuana manufacturing begins at a Class E felony for quantities between half an ounce and 10 pounds, with higher tiers above that threshold

The Drug-Free School Zone enhancement adds another layer of exposure. Any manufacturing offense committed on school grounds or within 500 feet of a school, preschool, childcare agency, public library, recreational center, or park triggers a one-level felony-class increase, turning a Class B into a Class A or a Class D into a Class C.

Tennessee’s Methamphetamine Promotion Statute

Beyond the general manufacturing statute, Tennessee Code § 39-17-433 creates a separate Class D felony for promoting methamphetamine manufacture. This charge covers knowingly selling or delivering precursor chemicals, permitting property to be used for manufacturing, and purchasing or possessing more than nine grams of an immediate methamphetamine precursor with intent to manufacture. Pseudoephedrine is the precursor most commonly at issue.

Possession of more than 15 grams of an immediate methamphetamine precursor is treated under the statute as prima facie evidence of intent to violate the promotion law. That presumption can drive a prosecution even when no clandestine laboratory is ever found.
